Q: How long can I remain at work before I have to take Maternity Leave?
A: You are able to work up to 6 weeks before the expected date of confinement or date set for caesarean delivery of your child. If you wish to work longer, you will need a doctor’s certificate stating that you are fit for duty until a specific date.
Q: What is the minimum period of Maternity Leave I can take?
A: You must commence maternity leave 6 weeks prior to the expected date of confinement or date set for caesarean delivery of your child and remain on maternity leave for 6 weeks following the birth of the child. Both these periods can be reduced if your doctor provides a medical certificate stating that you are fit for duty to a specific date or fit to resume duty from a specific date.
Q: How long do I have to work to be entitled to Maternity Leave?
A: 12 months or more continuously in any one or more Queensland Government departments or Queensland public service offices. This is called the qualifying service period.
Q: How many times can I access paid maternity leave?
A: There is no limit to the number of times an employee can access paid maternity leave as long as the qualifying service period has been reached.
Q: During a period of paid maternity leave I become sick for three days. Can I apply for 3 days sick leave?
A: No. To access paid sick leave, the period of illness must be for at least one calendar week, and supported by a medical certificate.
Q. During a period of unpaid maternity leave I become sick for 2 weeks. Can I apply for 2 weeks sick leave?
A. No, paid sick leave is not available to an employee on unpaid parental leave.
Q: What happens if I decide not to return back to work whilst on Maternity Leave?
A: Contact your manager.
Q: What happens if I get pregnant whilst on Maternity Leave?
A: You are entitled to access a further period of paid maternity leave and all other benefits associated with the birth of a child
Q: I am a temporary employee. Am I entitled to Maternity Leave?
A: Yes, providing the qualifying service period of 12 months has been reached.
Q: Can I decide to return to work part time whilst I am on maternity leave?
A: Yes, but you need to give at least 4 weeks notice of your request to enable your manager to accommodate your flexibility.
Q: Will I accrue long service leave whilst on Paid Maternity Leave?
A: Yes, periods of Paid Maternity Leave counts as service for all purposes.
Q: Can I access paid Maternity Leave on a half pay basis for 24 weeks?
A: Yes.
Q: Will my position be there when I return to work?
A: Yes, your job is protected if you have leave for up to 104 weeks.
