Site investigations / remediation
Land recorded on either register may be required to be investigated and assessed when an application is made for a material change of use or reconfiguration of a lot under the Integrated Planning Act 1997. More information about the Environmental Protection Act (EP Act) and the Integrated Planning Act (IP Act) is available at this site.Information about the IP Act can also be obtained from the Department of Local Government, Planning, Sport and Recreation.
In accordance with the EP Act, the EPA can only accept site investigation reports and validation reports prepared by people who are members of one of the prescribed organisations listed in Schedule 8A of the Environmental Protection Amendment Regulation. See the Agency’s information sheet Choosing a contaminated land consultant for a list of prescribed organisations and has qualifications and experience relevant to the site investigation.The contaminated land consultant performs the work and submits a report about the work to the EPA. The Agency reviews the consultant’s report. On the basis of the report and any additional work required by the EPA, the site may be removed from the CLR or EMR, or a site management plan (SMP) can be developed and a suitability statement may be obtained from the EPA.
