Object to the entry or removal of a place

General information

Under Section 37 (1) of the Queensland Heritage Act 1992 any person can lodge an objection to the entry or removal of a place in the Queensland Heritage Register. An objection period of 30 days is triggered once the Heritage Council gives public notice in writing that a place is to be entered in or removed from the Register.

Under the legislation, objectors must show grounds that the place is either not of cultural heritage significance or that it does not satisfy the entry criteria.

Guidelines and policies

Applicants should read the following information materials (available from the Cultural Heritage Branch) before lodging an application:

Pre-lodgement service

You may be contacted by an EPA officer if further information is required to support your application.

Permits and approvals

Once an objection is received, the Heritage Council appoints an independent assessor to investigate the objection. After considering the assessor's report, the Council then decides to either permanently enter the place in the Queensland Heritage Register or remove the provisional entry. Property owners who are dissatisfied with the outcome of this process may appeal to the Planning and Environment Court within 30 days.

Forms and fees

To make an objection you will need to lodge a completed application form with the Queensland Heritage Council. No fees apply.
