Environmental compliance codes
Section 549 of the Environmental Protection Act 1994 makes
provision for the Minister to approve codes of environmental compliance
that contain standard environmental conditions for carrying out
environmentally relevant activities (ERAs). Under this section, the
Minister can approve such conditions by gazette notice.
Mining
Codes of environmental compliance have been approved for use in certain
mining activities, and their approval is confirmed in Schedule 3 of the
Environmental Protection Regulation 2008. They are:
- Code of Environmental Compliance for Exploration and Mineral Development Projects
- Code of Environmental Compliance for Mining Claims and Prospecting Permits
- Code of Environmental Compliance for Mining Lease Projects
These codes provide a simplified and timely assessment and approval
process for standard mining activities which have a low level of
environmental impact and present a low risk of serious environmental
harm. In addition to standard environmental conditions, the codes
contain advisory notes that inform miners on the expectations of the
EPA on how to operate projects in compliance with the standard
conditions.
